1. Purpose and organizer of the offer

These conditions of participation and data protection regulations regulate the conditions for participation in the competition of OSRAM GmbH, Marcel-Breuer-Straße 4, 80807 Munich (OSRAM) as well as the collection and use of the data collected or communicated by the participants. By participating in the competition, the participant accepts the following conditions of participation and data protection notices.

2. Participants and Conditions of Participation

All persons who are at least 18 years old, who are resident in the EU (European Union) and who have declared their consent to the participation and data protection regulations are eligible to participate. Employees of OSRAM GmbH and its subsidiaries and affiliated companies as well as their relatives and employees of companies participating in the competition are excluded from participation. The chance of winning and participation are independent of the purchase of goods or services from OSRAM. OSRAM reserves the right to exclude participants from the competition due to incorrect information, manipulation, violation of these participation and data protection regulations or the use of unauthorized aids (including the use of competition services or similar). The competition will take place from April, 6th to April, 13th, 2023. The participant is solely responsible for the correctness of the data provided for participation in the competition. All personal data must be correct and correspond to the data of the participant.

3. Winning and Administering the Sweepstake

Mode:

The winners will be drawn at random.

Only one participation is possible per person. The competition will be published as a post on Facebook and Instagram. In the competition, participants must comment and like the post. In addition, users must also like the OSRAM Automotive Facebook page or Instagram channel AND register via the linked registration form from OSRAM Automotive.

OSRAM raffles 1 TYREinflate 2000 and 1 LEDinspect Flexible Head Torch in this competition.

4. Settlement of Winnings

The process from registration to distribution of prizes:

1. Participation via comment function on Facebook or Instagram AND via the linked registration form from OSRAM Automotive
2. All participants who meet the conditions mentioned in 3. are eligible to win
3. The winners will be drawn on April, 14th, 2023 by an online random generator. The winners will be notified by OSRAM Automotive on April, 14th, via a comment under the post and asked to send OSRAM Automotive a message. OSRAM Automotive will then send the winner a message on how the competition will be processed further. If the winner cannot be reached via comment within 24 hours of the first contact attempt or if he/she does not get back to OSRAM Automotive within 48 hours, the entitlement to the competition prize is forfeited and the organizer is entitled to choose another winner.
4. The prize will be sent by post at OSRAM's expense.

In the event of an undeliverable prize, OSRAM is not obliged to conduct further investigations. In this case, the claim to the prize is forfeited. The participant's entitlement to a prize also lapses if the prize cannot be sent correctly due to incorrect data.

5. Privacy Policy

By participating in the competition, the participant agrees to the collection, processing and use of the personal data (including name, address) listed under Section 4. The collection of the required personal data as part of the competition is used exclusively for the implementation of the competition by OSRAM and its commissioned companies, for the purpose of which they are transmitted to them. A transmission to third parties does not take place. You can object to the use and storage of data at any time by sending an email via the online contact form or preference center. In this case, all of the participant's data will be deleted and participation in the competition will be terminated.

Even after the conclusion of the contract, it may be necessary to store personal data of the contractual partner in order to comply with contractual or legal obligations. For example, your data must be stored within the framework of our business retention periods under commercial and tax law. Statutory retention periods of six and ten years apply to data relevant to tax and commercial law. The data of the winners are relevant for the accounting processing and must be kept as accounting documents. We must prove that the raffle was properly carried out and that the prize was provided within the statutory limitation periods. Data is only passed on to third parties for the purpose of transmitting the prize (logistics company). The winners' data will be passed on to the logistics company solely for the purpose of processing and transmitting the prize. The legal basis for this is Article 6 (1) (b) GDPR.

You have the right according to the legal requirements
• to revoke your consent to data processing at any time with effect for the future,
• to receive information from us about the personal data concerning you (Art. 15 DSGVO, § 34 BDSG), i.e. you can receive information from us about which data we process about you,
• for correction (Art. 16 GDPR), if the personal data stored by us is incorrect or incomplete,
• to restriction of processing (Art. 18 GDPR, § 35 BDSG), if we cannot or may not delete your personal data, but the prerequisites for restricting access and processing of your personal data are met instead,
• the right to data portability (Art. 20 GDPR), i.e. to receive the personal data you have provided to us in a structured, common and machine-readable format.

7. Participant Exclusion

OSRAM reserves the right to exclude participants from the competition who violate these conditions of participation and/or have manipulated or attempted to manipulate the entry process or the competition, e.g., by using sweepstakes services. In particular, OSRAM has the right to exclude participants from the competition to exclude obscene, offensive, incriminating, ethnically offensive, violent, pornographic, harassing, unsuitable for minors, racist, inciting, xenophobic, right-wing extremist photos and/or reprehensible photos, captions and/or comments.

If the foregoing exclusion conditions apply, all prizes may be refused and subsequently reclaimed.

8. Liability

OSRAM and its respective legal representatives and vicarious agents are only liable for damage suffered by the participant if the damage was caused intentionally or through gross negligence by OSRAM, its legal representatives or vicarious agents. This limitation of liability does not apply to damage resulting from injury to life, limb or health. Furthermore, it does not apply to the violation of essential contractual obligations. In such a case, OSRAM's liability in terms of amount and cause is limited to such damage that was typical and foreseeable at the time the contract of use was concluded. An essential contractual obligation is the obligation the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely.

9. Miscellaneous Provisions

These conditions of participation and the legal relationship between the participant and OSRAM are exclusively subject to German law.

Should individual provisions of the Conditions of Participation be or become invalid, the validity of the remaining Conditions of Participation shall remain unaffected.
